Welcome to Filmset! 

These terms and conditions set forth the guidelines and rules for the use of Filmset. By using any of the Filmset mobile applications and websites, it is assumed that you accept these terms and conditions. If you do not agree to accept all of the terms and conditions stated on this page, please do not use Filmset.

The following terms apply to these Terms and Conditions, Privacy Statement and Disclaimer Notice and all Agreements: “Client”, “You” and “Your” refer to the person who logs on to the Filmset mobile application and/or website and agrees to the Company’s terms and conditions. “The Company”, “Ourselves”, “We”, “Our” and “Us” refer to our Company. “Party”, “Parties”, or “Us” refer to both the Client and ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client’s needs in respect of the provision of the Company’s stated services, in accordance with and subject to, prevailing law of Netherlands. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to the same.

By downloading or using the Filmset app, these terms will automatically apply to you. Therefore, you should carefully read them before using the app. You are not allowed to copy or modify the app, any part of the app, or our trademarks in any way. You are not allowed to attempt to extract the source code of the app, and you should not try to translate the app into other languages or make derivative versions. The app itself, and all the trademarks, copyright, database rights, and other intellectual property rights related to it, still belong to DIGITAL FOOD SOLUTIONS (PTY) LTD.

DIGITAL FOOD SOLUTIONS (PTY) LTD is committed to ensuring that the app is as useful and efficient as possible. For this reason, we reserve the right to make changes to the app or to charge for its services, at any time and for any reason. We will never charge you for the app or its services without making it clear exactly what you are paying for.

The Filmset app stores and processes personal data that you have provided to us, to provide our service. It is your responsibility to keep your phone and access to the app secure. We recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. Doing so could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone’s security features, and it could mean that the Filmset app will not work properly or at all.

The app uses third-party services that declare their terms and conditions. You should be aware that DIGITAL FOOD SOLUTIONS (PTY) LTD will not take responsibility for certain things. Certain functions of the app will require the app to have an active internet connection. DIGITAL FOOD SOLUTIONS (PTY) LTD cannot take responsibility for the app not working at full functionality if you do not have access to Wi-Fi and you do not have any of your data allowance left.

If you are using the app outside of an area with Wi-Fi, the terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing the app, or other third-party charges. In using the app, you are accepting responsibility for any such charges, including roaming data charges if you use the app outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you’re using the app, please be aware that we assume that you have received permission from the bill payer for using the app.

Along the same lines, DIGITAL FOOD SOLUTIONS (PTY) LTD cannot always take responsibility for the way you use the app. For example, it is your responsibility to ensure that your device stays charged so that you can use the app. If your device runs out of battery and you are unable to use the app, DIGITAL FOOD SOLUTIONS (PTY) LTD cannot be held responsible.

While we make every effort to ensure that the app is updated and correct at all times, we do rely on third parties to provide us with information so that we can make it available to you. Therefore, DIGITAL FOOD SOLUTIONS (PTY) LTD accepts no liability for any loss, direct or indirect, that you may experience as a result of relying wholly on the functionality of the app.

At some point, we may need to update the app. The app is currently available on both Android and iOS platforms. The requirements for both systems (and for any additional systems that we may decide to extend the availability of the app to) may change, and you will need to download the updates if you wish to continue using the app. While DIGITAL FOOD SOLUTIONS (PTY) LTD does not promise to always update the app so that it is relevant to you and works with the version of Android or iOS installed on your device, you are responsible for always accepting updates to the app when they are offered to you.

We may also wish to stop providing the app and may terminate your use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, the rights and licenses granted to you in these terms will end, and you must stop using the app and delete it from your device.

These terms and conditions constitute the entire agreement between DIGITAL FOOD SOLUTIONS (PTY) LTD and you concerning your use of the Filmset app and supersede all prior agreements and understandings regarding the same. If any part of these terms and conditions is held to be invalid or unenforceable, the remaining parts will remain in full force and effect.
